ARTICLE 1: ORGANISER

PARADE, a simplified joint-stock company with capital of €10,200,000, whose head office is located at Route du Chaudron en Mauges - Saint Pierre Montlimart - 49110 MONTREVAULT SUR EVRE, is organising a free competition with no obligation to buy on the website via a form, from 3 April 2023 at 9 am to 23 April 2023 at 11.59 pm. 

Said company is also referred to hereinafter as "the organising company"

ARTICLE 2 - COMPLIANCE WITH THE COMPETITION RULES

By taking part in this Competition, all participants are deemed to be aware of and to have expressly and unreservedly accepted all the provisions of these rules.

The participant declares that he/she meets all the conditions required to take part in the Competition and undertakes to comply with the conditions of these rules and the applicable laws and regulations.

ARTICLE 3 - ACCESS TO THE COMPETITION

Participation in the Competition is open to all natural persons of legal age residing in mainland France who have an Internet connection and a valid email address.

The Competition is limited to one entry per person (same surname, first name) for the duration of the Competition.

Participation is strictly nominative. Any multiple participation by the same person under cover of several accounts or pseudonyms or on behalf of other participants is prohibited and will be analysed as fraud in the Competition.

Employees of the Organising Company and their families, including cohabitants, or of any other company whose capital is controlled, directly or indirectly, by ERAM, a simplified joint-stock company with capital of €73,600,000, are excluded from entering the Competition, whose registered office is located at SAINT PIERRE MONTLIMART - MONTREVAULT-SUR-EVRE (49111), registered in the ANGERS Trade and Companies Register under number 388 583 239, as well as the ancestors or descendants of these employees, and in general of the companies participating in the direct or indirect implementation of this Competition.

ARTICLE 4 - REGISTRATION AND PARTICIPATION IN THE COMPETITION

Eligible persons wishing to take part in the Competition must follow the following procedure:

- Complete the competition form on the site to take part in the prize draw: title, surname, first name, profile, telephone number, email address, acceptance of the legal information

The participant authorises the Organising Company to proceed, in case of doubt, with any verification of the data provided in order to ensure their veracity.

No registration by any other means of communication will be accepted.

The closing date for participation in the Competition is 23 April 2023 at 11.59 pm.

Entries will be considered invalid if they are sent after the entry deadline or if they are incomplete, incorrect, illegible or fraudulent.

ARTICLE 5 - DETERMINATION OF WINNERS AND RESULTS 

A random draw will select 3 winners from all eligible entrants. This draw will be carried out by Mylène ABLIN, web marketing & CRM coordinator, at Parade on 25 April 2023. 

ARTICLE 6 - PRIZES

The competition prizes are:

  •  A €100 voucher, valid from 25 April 2023 to 25 October 2023, to be used in a single purchase, exclusively on the parade-protection.com website.
  •  A SAMANA isothermal rucksack
  • ABAHIA cap

The Organising Company reserves the right to replace these prizes with another prize of equivalent value and characteristics, for any reason whatsoever, without being held liable in this respect.

The prize may not be transferred or exchanged for an object or any other monetary value. The prize may not be contested, returned, reimbursed in cash or given as consideration of any kind whatsoever.

ARTICLE 7 - PROVISION AND TRANSPORT OF PRIZES

The winners will be contacted by email on 25 April 2023.

The voucher prize will take the form of a special coupon to be used on the website and valid for 6 months from the date the email is sent to the winner.

The SAMANA rucksack and ABAHIA cap will be sent by post. The postal address of the winners will be communicated to the marketing department by email when contact is made following the designation of the winners.  If one of the winners does not reply within 2 months of the email announcement, and therefore does not provide his/her postal address, he/she will be deemed to have forfeited the prize in question and it will be deemed to have been cancelled.

Any incomplete or inaccurate entry will not be taken into account and will result in the entry being null and void. Any ineligible winner (having expressly or tacitly renounced the prize, false declaration, several winners per household, several entries per person) will not be awarded the prize and the prize not awarded will not be reassigned to another participant. The prize will therefore be considered cancelled.

Any fraud or failure to comply with these rules may result in the player being excluded from the competition. Any dispute or claim relating to this competition must be made in writing and sent to the organiser's address and will not be taken into consideration after a period of one month from the end of the competition.

ARTICLE 8 - CONDITIONS FOR REPLACING PRIZES

The Organising Company reserves the right, in the event of force majeure as provided for by French law and jurisprudence, to replace the advertised prize(s) with one or more prizes of equivalent value, without any possible dispute on the part of the participants.

ARTICLE 9 - REIMBURSEMENT OF THE COSTS OF PARTICIPATING IN THE COMPETITION

All participants may obtain a refund of their participation fees by sending a written request to the following address: PARADE - Service Communication, SAINT PIERRE MONTLIMART - MONTREVAULT-SUR-EVRE (49111).

In this respect, they may request reimbursement of their postage and connection costs.

The cost of postage will be reimbursed on the basis of a simple 20g envelope stamped at the current Ecopli rate.

Connection costs will be reimbursed on the basis of a France Télécom PSTN connection time of five (5) minutes at €0.02 per minute, i.e. €0.20 (including the call set-up fee of €0.10). However, connection costs will not be reimbursed for Internet users with a flat-rate Internet subscription, on the understanding that this type of subscription is used for general Internet use and not exclusively for participation in the Competition.

The request for reimbursement must be sent within thirty (30) days after the end date of the Competition (as evidenced by the postmark), and be accompanied by the following documents: an explanatory letter with the participant's contact details, the date and time of the connection and its duration, proof from the Internet Service Provider that billed the connection, a bank statement.

The refund will be made by bank transfer after verification of the validity of the request. Any request for reimbursement that is not sent in writing, is incomplete, erroneous or not legitimate will not be taken into account.

ARTICLE 10 - TRANSFER OF WINNERS' RIGHTS

By participating in the Competition, the persons registered agree to unconditionally assign to the Organising Company, in the event that they are designated as winners, the rights of reproduction, distribution and use of their surname, first name, age, town and pseudonym for a period of five (5) years within the territory of the European Union.

The rights thus assigned may be used by the Organising Company for the exclusive purpose of its advertising and promotional communication by any means and on any medium, without this use giving rise to any right and/or remuneration on any grounds whatsoever.

ARTICLE 11/ INTELLECTUAL PROPERTY

All trademarks, logos and other distinctive signs, as well as all intangible creations appearing on the Competition site and on sites to which it provides access via hypertext links, are the exclusive property of their owners and are protected as such by the provisions of the French Intellectual Property Code.

As a result, any reproduction or representation, without the express prior authorisation of the author(s) concerned, of all or part of their work(s) or private rights is strictly prohibited and constitutes an infringement of copyright.

ARTICLE 12 - DATA COLLECTION AND PROCESSING

In the course of the Competition, any information provided by registered participants will be collected, processed and stored by the Organising Company and not by Facebook and Instagram, in compliance with the legislation in force and the opinions of the CNIL, and in particular with the French Data Protection Act, as well as the General Data Protection Regulation (EU Regulation 2016/679 of 27 April 2016) relating to data processing, files and freedoms. The Organising Company is solely responsible for the processing and recipient of the data. The information collected will not be passed on to third parties without the consent of the persons concerned.

Personal data is collected, processed and used for the following purposes:

  • to take into account the participation of the persons concerned by the Competition,
  • to identify the winners and contact them to award the prizes,
  • to manage canvassing and commercial communication by the organising company, with the consent of participants, to send information and preferential commercial offers from the organising company and their partners, where applicable.
  • to publish the list of winners (first name and first letter of the surname),
  • to manage any complaints or cases of fraud,
  • to comply with all applicable laws and regulations.

Any participant who exercises his/her right to delete his/her data before the end of the Competition will be deemed to have waived his/her participation.

The data collected is kept for the time required for the Competition and the delivery of the prize. If you have also consented to receive commercial canvassing, the Organising Company will keep your data for the purpose of sending you commercial canvassing for a period of 3 years, unless you subsequently object.

None of the data collected is transferred outside the European Union.

In this respect, participants have a right to access, rectify, delete and, as well as a right to freedom and portability of the data concerning them, object to its processing by the Organising Company.

Subject to their explicit consent or, as the case may be, in the absence of any objection on their part, the information collected about the participants may be used by the Organising Company in order to serve them better and to inform them of new products and offers that may be of interest to them.

ARTICLE 13 - LIABILITY

The Organising Company shall not incur any liability whatsoever if, in the event of force majeure, as described by French law and jurisprudence, or in the event of events beyond its control or justified necessity, it is forced to cancel the Competition, stop it, shorten it, extend it, postpone it or modify its conditions. In all cases, it reserves the right to extend the participation period.

Participants will be informed of any changes by any appropriate means.

Nor shall the Organising Company be held liable, and no recourse may be taken against it, in the event of the occurrence of events presenting the characteristics of force majeure or any other event (strikes, bad weather, etc.) partially or totally depriving the winner(s) of the benefit of his/her/their prize(s).

Failure of the internet, computer equipment, other technologies

All participants declare that they have sufficient knowledge to use IT equipment (e.g. computer) or other technology (e.g. mobile phone) and to navigate on the Internet.

The Organising Company declines all responsibility in the event of misuse or incident related to a participant's mobile phone.

All participants are aware, and accept, that the proper running of the Competition may be disrupted by malfunctions, failures and the specific characteristics of the Internet network, IT or technology, such as (non-exhaustive list): slowness of connection and browsing, saturation of the site or network, network cuts, absence of network, presence of cookies, possibility of contamination (e.g. virus, spyware), loss of data, hacking of data on his/her terminal, software and hardware compatibility problems, limited technical performance of the equipment used.

In any event, the Organising Company may not be held liable for any technical failure affecting the running of the Competition on the Internet that is beyond its control.

Nor is it liable for any damage, whether material or immaterial, or for any consequence, direct or indirect, that may result from the participant's misuse, negligence or lack of knowledge of the Internet network, computer equipment or any other technology used.

Defects, improper use of prizes

The Organising Company declines all liability in the event of a defective prize, use of the prize by the winner in a manner that is not compliant or contrary to the instructions provided, and any consequential, material or immaterial, direct or indirect damage that may result.

ARTICLE 14 - FRAUD IN THE COMPETITION

The Organising Company reserves the right, without prejudice to any legal action, to cancel a person's participation and to refuse to distribute any prize(s) that may have been won if that person has committed or attempted to commit fraud against the rules of these Rules or the laws and regulations in force.

The Organising Company shall not be held liable for any fraudulent acts committed by a participant, who shall be solely responsible for the direct and indirect consequences of their acts.

ARTICLE 15- ISSUE OF THE RULES

These rules are available free of charge to any interested party who submits a written request to the following address: Parade – Service Communication, SAINT PIERRE MONTLIMART - MONTREVAULT-SUR-EVRE (49111).

The postage costs associated with sending a request for a copy of the Competition rules will be reimbursed upon simple written request attached to the request for the rules, on the basis of a simple 20 g envelope stamped at the second class rate in force.

ARTICLE 16 - COMPLAINTS

Any complaint must be made by post to the Organising Company at the following address: Parade – Service Communication, SAINT PIERRE MONTLIMART - MONTREVAULT-SUR-EVRE (49111).

Only claims deemed admissible under these Rules and sent within sixty (60) days of the end date of the Competition will be considered, as evidenced by the postmark. The letter must include an explanatory letter giving the reason for the dispute and the participant's contact details.

Facebook and Instagram are not behind this competition. It is specified that this Competition is in no way associated with, managed or sponsored by Facebook and Instagram. Under no circumstances can they be held liable.

All questions, comments or disputes must be addressed exclusively to the Organising Company and not to Facebook and/or Instagram.

ARTICLE 17- APPLICABLE LAW - SETTLEMENT OF DISPUTES

These Competition rules are governed by French law.

In the event of a disagreement between the Organising Company and a participant regarding the validity, interpretation, execution, non-execution or consequences of these Rules, said persons shall attempt to resolve the dispute amicably. If no agreement is reached within thirty (30) days, the dispute may be brought before the competent courts in the jurisdiction of the defendant's home.
